The parties
The agreement binds the school (the person or institution asking for the address, “the school”) and Chris Guitar Tuto · Live Session Tech, Christopher Jean Meyepa, Rue Centrale 107, 2503 Biel/Bienne, Switzerland (“we”). It adds to the Terms of use. Places, price and duration are agreed separately in writing (an e-mail or WhatsApp message is enough).
What the school gets
An address in its name, with its name, logo and colours, on the same engine as the Chris Guitar Tuto Method app. By default, a blank course: the school writes its own lessons with “Build my lessons”.
The essentials library: chords, scales, modes, arpeggios, grooves and fingerings. It is generated from the rules of music, and the school uses it freely inside the app.
What belongs to the school
Its lessons, videos, texts, logo and name remain its own. It only allows us to store and show them to its students so the app works, for as long as the agreement runs.
Chris’s method: only with the Method licence
Chris’s four-year course, lessons, riffs, books and videos are available only while the Method licence is active. The school and its students read them in the app, read-only.
Not allowed: copying, exporting, recording, reselling or sharing them outside the app, or using them for another product. When the licence ends, access ends.
The school’s responsibility
The school is solely responsible for the content it creates, uploads or shares in the app, and for that of its teachers and students. Chris Guitar Tuto is not.
The school guarantees that it holds the rights to everything it uploads: songs, recordings, scores, tablature, photos, videos. It guarantees that it has the consent of the people filmed or recorded, and parental consent for every under-age student.
The relationship with its students and their parents is the school’s: enrolment, prices, lessons, complaints, refunds. We are not a party to those contracts.
For that content, Chris Guitar Tuto is only the technical host. We do not check it before it goes online. When unlawful content is reported to us, we act: we remove or block it and tell the school (see Report a copyright problem).
Indemnity
The school holds Chris Guitar Tuto (Live Session Tech) harmless against any third-party claim caused by its content, its teachers’ or students’ content, or a breach of this agreement. It covers the resulting costs, including reasonable legal fees. We tell the school promptly and let it take part in the defence. [Clause to be checked by the lawyer.]
Students’ data
For its students’ data, the school is the controller and Chris Guitar Tuto (Live Session Tech) is the processor. We process that data only to run the school’s app and on its instructions; we use it for nothing else and never sell it.
We keep the data confidential, protect it (encrypted connections, per-account access, backups), help the school answer its students’ requests (access, export, deletion) and tell it without delay about a security incident. Our providers (hosting, e-mail, lesson room) are listed in the Privacy policy; we tell the school before changing them.
The school informs its students and their parents, and collects the consents needed.
Places and billing
The number of student places is set in the agreement; the app enforces it. Billing is done by hand, by invoice, outside the app. A change of places or price applies from the next month.
Badge and brand
The school uses its own name. It may say “Chris Guitar Tuto Method” only while the Method licence is active, and “Certified Chris Guitar Tuto Method Teacher” only for a certified teacher. No use of the Chris Guitar Tuto logo without written agreement.
Ending the agreement
Either party may end the agreement with one month’s written notice. We may end it at once after a serious breach (unlawful content, copying the method, non-payment after a reminder).
At the end, the school may ask for an export of its data (its lessons, its students, their progress and recordings) within 30 days. After that, we delete the school’s data, except what the law requires us to keep (invoices).
Chris Guitar Tuto’s liability
We provide the app as it is, with care, without a guarantee of permanent availability. Our liability towards the school is limited to the amount the school paid in the last twelve months, except for gross negligence or intent.
Governing law
